General Conditions of Sale

General information

Any order rightfully includes unreserved acceptance by the buyer of all of the conditions below and a waiver of any stipulation in its own general conditions which would be incompatible with the provisions below:

  • unless there are special agreements, our pricing proposals become null and void 30 days after the date on which they were made;

  • the prices in the catalogs and tariffs can undergo variations at any time, in relation to the tariffs of our suppliers. For any order, the buyer must request communication of the applicable price;

  • the information and indications in the catalogs are indicative only and do not commit Belmar, which reserves the right to make any changes to the shape, dimension or material of the equipment listed in our publications.

  • the goods travel at the risk of the recipient, even in the case of prepaid shipping. The recipient should check the shipments on arrival, and under conditions of use, to establish whether there is any claim to be made against the carriers.

 

Article 1 – Pricing and conditions

Article 2 – Return of goods

Returns of goods are accepted only if we have previously authorized their return.

They must reach us free of all fees, at home.

Belmar will establish a credit note, reserving the right to impose a reduction, depending on the dilapidation, the condition of the packaging or the opportunity to return the goods to the manufacturer.

Material defects, as well as errors in size, quality, quantity or weight only oblige Belmar to purely and simply replace the products in question.

 

 

Article 3 – Claims

Claims should be sent within 3 days following receipt of goods, and within a maximum period of 3 months from the date of on which our invoice is issued. Failing this, claims will not be accepted. Reception of a package in poor condition must be notified to the carrier before accepting the delivery.

 

 

Article 4 – Shipping

The parcels delivered travel at the recipient’s risk, even in the case of prepaid deliveries. The carrier is responsible for damage and delays in delivery, and the recipient must express reservations, if necessary, prior to accepting delivery of the package or packages.

 

 

Article 5 – Payments

  • Our invoices, issued on the day of the shipment or when making available, are payable, unless there is a derogation, after 30 days, by bank draft, promissory note, check or bank transfer. Discount for early settlement: 1% per month.
  • Any invoice that is unpaid on maturity, in whole or in part, will give rise to invoicing of late payment interest. Penalties for late payment: 1.3% per month.
  • In the event of recovery by way of litigation, the unpaid amounts will be increased by 15% that the debtor is obliged to pay as a Penalty Clause.
  • Reservation of ownership: The delivered goods remain the property of Belmar until full payment of our invoice (Law No. 80335 of 12/05/1980).
  • The buyer bears all the risks that the delivered goods could cause until the full payment of the price.
  • Any cancellation or change in the terms and conditions of an order on the part of the customer, will be effective only after written acceptance from Belmar. The customer will bear the damages and interest induced by these changes.

 

 

Article 6 – Warranty

We apply and pass on the construction guarantee of our suppliers with replacement of defective parts within the limit of the contractual period starting from the date on which the equipment was made available.

 

 

Article 7 – Disputes

For any disputes, whatever their object, French law is the only applicable law and the Commercial Tribunal of Brest (France) is the sole competent court, even in the case of third-party appeals or multiple defendants.
